Space
The space on your website is yours to use. Constant monitoring should be done if you plan to allow FTP access to your website for uploading. You take full responsibility for every file located on your website. Hosting of illegal files, or anything not allowed in this TOS agreement will result in suspension of your account until future investigation is made.

Available Resources
When signing up for an account, you are presented with a choice of available hosting packages. Each package includes specific resources that may or may not be available based on the package selected. Due to the overall integrity that we must maintain in regards to our server(s) will not install or make available packages and/or resources based solely on customer request. If you have specific needs that require such software to be installed, you must submit a request using the contact form provided. Once received, a technician will investigate the possibility of including such software as an overall resource to be made available to all customers. We reserve the right to deny any such request that we feel may degrade the integrity of our server(s) or jeopardize the websites, files, or data of our customers. You agree not to attempt to install, upload, or otherwise transmit any software which has not been authorized by a CG Design technician.

Account Data Loss
We create scheduled backups of all data stored on the web server(s), however we make no guarantees that any specific file(s) may or may not be backed up at any given time. Therefore, it is your responsibility to ensure that you have adequate backups in case of data loss due to hardware and/or software failure. In no event will CG Design and/or its affiliates be liable for any damages, including without limitation, direct or indirect, special, incidental, moral or consequential damages, loss of profits, opportunities or information or for expenses arising in connection with any web hosting services provided. By signing up and/or purchasing any form of hosting services available, you agree to be bound by these terms.

Security Updates/Patches
You are solely responsible for keeping your software and/or scripts that are installed on your hosting account updated with the latest security updates and/or patches. Failure to do so causes a security issue that could compromise your website and/or the overall integrity of the web server(s) that it is being hosted on. If we find an account that has been compromised we will suspend the account and contact the owner. If this happens more then once, we reserve the right to terminate your account and delete the affected file(s).

Account Suspension/Termination
We reserve the right to suspend and/or terminate your account if we suspect and/or have reason to believe you are violating this agreement. We will attempt to notify you via email and/or telephone to discuss the reason for suspension/termination, and offer you the ability to correct any issues prior to making a final decision. A hosting account may also be terminated at any time by either party, without penalty, by giving the other party 30 days written notice. Notice must be made by mail or electronic mail. CG Design will not accept termination notices over the telephone. If such notice is given, customer agrees to make necessary arrangements to backup and/or move any data contained in the account to another location. Once a termination notice has been submitted, the account will be automatically deleted at any time 30 days from the date of the notification. CG Design reserves the right to charge a fee equal to three months of the current service plan for reinstatement of any account that has be terminated.

Misuse of Resources
The misuse of resources which will result in immediate suspension and/or termination of your account without refund include, but are not limited to, the following:

• Installing, employing, or otherwise utilizing any application or script that consumes excessive CPU time, network utilization, or any other service and/or application that degrades the overall performance of our web server(s)
• Installing, employing, or utilizing any application or script to gain access to any files or directories on our server(s) which are not part of your hosting account
• Any form of unauthorized access to personal, private, proprietary and/or sensitive information stored on our server(s)
• Any form of unauthorized access to company data including, but not limited to, customer hosting account information, account status, and/or other sensitive data
• Any form of malicious activity which may be aligned with the common understanding of "hacking" and/or "improper use of a public computer network".
• Any attempt to sabotage, irrepairably alter, destroy, delete, or otherwise cause a denial of service directly or indirectly to or from our server(s)

Content
If you are unsure if the content that you wish to make available violates any part of these terms and conditions, you must first contact us using the provided form prior to making such material available.

Domain Registration
If we register a domain on your behalf, the domain becomes part of our reseller domain registration account. If you wish to transfer the domain to another registrar, you must contact us to allow us to take the neccessary steps to transfer the domain.
